Westerfer Contracting Company – General Contract Disclaimer
1. Scope of Work Westerfer Contracting Company (“Contractor”) will perform only the work described in the approved estimate, proposal, or contract. Any additional work, changes, or modifications requested by the Client must be agreed upon in writing and may result in additional charges and time extensions.
2. Site Conditions The Contractor is not responsible for pre-existing or hidden damage, subgrade deficiencies, or other unforeseen site conditions that may impact project results. The Client agrees to provide clear access to the work area, ensure adequate power and water availability, and remove any obstacles or hazards prior to the start of work.
3. Materials and Finish All materials used will meet or exceed industry standards for masonry and concrete floor coating applications. Minor color, texture, or gloss variations are inherent to concrete and coating systems and shall not be considered defects.
4. Weather and Environmental Factors Project timelines and performance are subject to weather and environmental conditions. The Contractor reserves the right to delay or reschedule work to maintain quality and safety. The Contractor is not responsible for delays caused by weather, supply chain issues, or other factors beyond its control.
5. Warranty Westerfer Contracting Company provides a limited workmanship warranty as stated in the specific project agreement. This warranty does not cover damage resulting from misuse, neglect, structural movement, hydrostatic pressure, chemical spills, or normal wear and tear. No other express or implied warranties, including merchantability or fitness for a specific purpose, are provided.
6. Maintenance Responsibility The Client is responsible for proper maintenance of all surfaces after project completion, including cleaning, sealing, and avoiding harsh chemicals or abrasive cleaning tools that could damage coatings.
7. Limitation of Liability In no event shall the Contractor be liable for incidental, indirect, or consequential damages, including but not limited to loss of use, loss of profits, or damage to personal or business property. The Contractor’s total liability shall not exceed the total amount paid under this contract.
8. Payment Terms All payments are due as specified in the contract or invoice. Late payments may result in interest charges, collection fees, and/or work suspension. Ownership of materials and completed work remains with the Contractor until payment in full is received.
9. Acceptance of Terms By signing or otherwise accepting this agreement, the Client acknowledges that they have read, understood, and agreed to the terms outlined in this disclaimer and the accompanying contract or proposal.
